These Terms of Service ("Terms") form a binding agreement between you and Altic LLC ("we", "us", "our", or "BookMyRealEstate") governing your use of bookmyrealestate.com and any related services (the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you are a real estate agent listing properties on the Services, additional terms apply — see the BookMyRealEstate Agent Agreement (which is incorporated into these Terms by reference).
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent that you meet these requirements.
The Services are intended for users located in the United States. By using the Services from outside the US, you acknowledge that your information will be transferred to and processed in the United States.
2. The Services — what we are and what we are not
2.1 What we are
BookMyRealEstate is an online listing platform that hosts third-party property listings posted by US real estate agents and enables prospective buyers to browse listings and contact agents directly.
2.2 What we are not
BookMyRealEstate is not:
- A real estate broker, agent, or salesperson.
- A party to any real estate transaction.
- An escrow agent, title company, or transaction intermediary.
- A provider of legal, financial, tax, or real estate advice.
- A guarantor of any listing's accuracy, availability, price, or condition.
- A guarantor of any agent's qualifications, performance, or conduct.
- Responsible for any agreement, transaction, or dispute between buyers and agents.
All real estate transactions occur outside the Services between the buyer and the agent (and any other parties involved). We do not facilitate, negotiate, or take any part in those transactions.
3. Accounts and registration
3.1 Buyers
Buyers may browse public content without an account. To contact an agent via chat or request a property visit, buyers must verify an email address via a one-time code. Verified buyers may use a "My Account" surface to view their conversations, visit requests, and saved listings.
3.2 Agents
Agents must register and complete identity and license verification before any listing or profile content is published. Agent use is also governed by the BookMyRealEstate Agent Agreement.
3.3 Your responsibilities
You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your account credentials.
- Promptly notify us of any unauthorized use of your account.
- Be responsible for all activity under your account.
4. Acceptable use
You agree NOT to:
- Violate any law, including the Fair Housing Act and equivalent state/local laws.
- Post or transmit content that discriminates on the basis of race, color, religion, sex, national origin, familial status, disability, or any other class protected by federal, state, or local law.
- Post false, misleading, fraudulent, or scam content.
- Impersonate any person or entity, including a real estate agent or brokerage you are not affiliated with.
- Use the Services to harass, threaten, or harm any person.
- Post or transmit malware, viruses, or other harmful code.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or our systems.
- Scrape, harvest, or otherwise extract data from the Services in bulk without our prior written consent.
- Interfere with or disrupt the Services or servers.
- Use the Services to send spam, phishing, or unsolicited commercial communications.
- Bypass any access controls, rate limits, or technical protection measures.
- Reverse engineer, decompile, or attempt to derive the source code of the Services.
Violations may result in immediate suspension or termination, content removal, refusal of refund, and legal action.
5. Content
5.1 Your content
You retain ownership of content you post (listings, photos, bio, messages, etc.) ("Your Content"). By posting Your Content, you grant Altic LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, distribute, modify (for formatting and technical purposes), and publicly display Your Content for the purposes of operating, promoting, and improving the Services. This license continues for content displayed in our Recently Sold archive even after a listing closes.
You represent that you own or have all necessary rights to Your Content and that it does not infringe any third-party rights.
5.2 Public nature of agent and listing content
Agent profile content and listings are intended to be public and indexable by search engines. Do not post information you do not want to be public.
5.3 Our content
The Services, including their design, software, look and feel, branding, and templates (excluding Your Content), are owned by Altic LLC or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
5.4 Content removal
We may remove, hide, or modify any content at any time, with or without notice, including but not limited to content that:
- Violates these Terms or the Agent Agreement.
- Violates Fair Housing or other anti-discrimination laws.
- Is fraudulent, misleading, or a scam.
- Is reported by other users and confirmed in our review.
- Is required to be removed by law or a lawful request.
We are not obligated to retain or restore removed content.
5.5 Reporting violations
To report listings, profiles, or messages that violate these Terms, email support@alticllc.com with details.
6. Agents, licensing, and verification
6.1 License requirement
Only individuals who hold a valid, active US real estate license (or are otherwise legally authorized to advertise real property for sale in the relevant jurisdiction) may register as agents.
6.2 Our verification — disclaimer
We perform license verification at signup as an anti-fraud measure. However:
- We do not guarantee the accuracy of license records or the current status of any agent's license.
- License status can change at any time and we may not detect changes immediately.
- Verification by us does not constitute an endorsement, recommendation, or vouching for any agent's qualifications, character, or performance.
- Buyers should independently verify any agent's credentials before engaging them.
6.3 Buyer–agent dealings are between them
Any agreement, communication, transaction, or dispute between a buyer and an agent is solely between those parties. Altic LLC is not a party and is not responsible for the outcome.
7. Communications and chat
7.1 Chat and visit requests
The Services include chat and visit-request features. When you use these features, your messages and contact information are shared with the other party as described in our Privacy Policy.
7.2 We may monitor
We may, but are not obligated to, monitor communications on the Services to detect violations of these Terms, including Fair Housing violations. We may store communications as required for compliance, dispute resolution, and legal purposes.
7.3 No professional advice
Communications on the Services do not constitute legal, financial, tax, or real estate advice. Agents' communications are their own.
8. Paid services and billing (agents)
8.1 Pricing
Active listings are subject to subscription fees as published on the Services (currently $10 per listing per month, subject to change). Founding-member terms, if offered, are documented at the time of acceptance.
8.2 Payment
Payments are processed by Stripe. By providing payment information, you authorize us (through Stripe) to charge the applicable fees. You are responsible for keeping payment information current.
8.3 Auto-renewal
Subscription fees recur monthly while listings remain active. Removing a listing or marking it sold stops billing on that listing from the next billing cycle.
8.4 No refunds
Fees are non-refundable except where required by law or expressly stated. Mid-month removal of a listing does not entitle you to a refund of the current month's fee.
8.5 Price changes
We may change fees with at least 30 days' notice. Changes apply at the start of the next billing cycle. Founding-member rates, where granted, remain at the rate stated at signup unless founding-member status is revoked under the Agent Agreement.
8.6 Taxes
You are responsible for any taxes, duties, or government fees applicable to your use of paid features, except for taxes on our income.
9. Suspension and termination
9.1 By you
You may close your account at any time by emailing support@alticllc.com. Closure stops future billing but does not entitle you to a refund of fees paid.
9.2 By us
We may suspend, terminate, or restrict your access to the Services at any time, with or without notice, for any reason, including:
- Violation of these Terms or the Agent Agreement.
- Suspected fraud, abuse, or violation of law.
- Loss or lapse of real estate license (for agents).
- Failure to pay fees.
- Risk to other users or to Altic LLC.
- Discontinuation of all or part of the Services.
9.3 Effect of termination
On termination:
- Your access to the Services ends.
- Your listings may be hidden or removed.
- Your agent profile may be unpublished.
- Your in-flight chats may be notified that you are no longer on the platform.
- Sections that by their nature should survive termination (including ownership, indemnification, disclaimers, limitations of liability, and dispute resolution) survive.
10. Disclaimers
10.1 "As is"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.2 No guarantees
WE DO NOT WARRANT THAT:
- The Services will be uninterrupted, secure, or error-free.
- Listings, prices, or property information are accurate, current, or complete.
- Any agent will respond to a buyer.
- Any property advertised will be available or will sell at the stated price.
- Use of the Services will result in any particular outcome (e.g., a sale, a lead, a closing).
10.3 Third-party content and links
The Services contain content from third parties (agents, brokerages, embedded videos). We are not responsible for that content. Links to third-party sites (e.g., agent booking pages) are provided for convenience; we do not endorse the linked sites.
10.4 No professional advice
Nothing on the Services is legal, financial, tax, or real estate advice. Consult licensed professionals for those matters.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- ALTIC LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
- WE ARE NOT LIABLE FOR ACTS, OMISSIONS, OR CONDUCT OF AGENTS, BUYERS, OR ANY OTHER THIRD PARTY USING THE SERVICES.
Some jurisdictions do not allow certain limitations of liability. The above limitations apply to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Altic LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Services.
- Your content.
- Your violation of these Terms or the Agent Agreement.
- Your violation of any law or third-party right (including Fair Housing laws, intellectual property, or privacy rights).
- Your interactions with other users.
13. Dispute resolution and governing law
13.1 Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
13.2 Informal resolution
Before filing any formal claim, you agree to contact us at support@alticllc.com and attempt to resolve the dispute informally for at least 30 days.
13.3 Arbitration
Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in [CITY, DELAWARE — or alternative agreed venue] or by video conference at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction.
13.4 Class action waiver
You agree to resolve disputes on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action. If this class-action waiver is found unenforceable, then the arbitration agreement in §13.3 is also unenforceable, and disputes will be resolved in court (see §13.5).
13.5 Exception
Either party may bring an individual action in small-claims court for qualifying disputes. Either party may also seek injunctive relief in court to protect intellectual property rights.
13.6 Time limit
Any claim relating to the Services must be filed within one (1) year after the cause of action arises, or it is permanently barred (to the extent permitted by law).
14. General
14.1 Entire agreement
These Terms, together with the Privacy Policy and (for agents) the Agent Agreement, constitute the entire agreement between you and Altic LLC regarding the Services.
14.2 Changes to Terms
We may update these Terms from time to time. For material changes, we will provide notice (e.g., a notice on the site or email to registered users) at least 30 days before the change takes effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
14.3 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
14.4 No waiver
Our failure to enforce any provision is not a waiver of our right to do so later.
14.5 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
14.6 Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (acts of God, war, terrorism, civil unrest, internet failures, government action, pandemic, etc.).
14.7 No agency
These Terms do not create any partnership, agency, joint venture, or employment relationship between us and any user.
